The Newhall Rotary Foundation is the sponsoring organization of House of Your Choice raffle to benefit local charities. Three Options for First Prize Valued at $1,000,000
Rules:
Option One - You Chose the House of Your Choice
When you purchase your on-line $100 entry at www.houseofyourchoice.org (HOYC), your name will be entered in a drawing to win an existing house of your choice anywhere in the contiguous United States of America that state laws allow. We recommend that the purchase price of the house not exceed $600,000 in order to allow for sufficient funds for other expenses incurred as part of winning the Grand Prize. The purchase price will be paid to an escrow company upon delivery of a title to the house of your choice. The balance of the prize winnings will be paid direct to the winner at close of escrow. Please note that HOYC is required to withhold state and federal withholding taxes.
The purchase price must include the house and land sales price, any sales commissions, one year of estimated property taxes, appraisal fees, fees for an independent qualified building inspectors report to be signed by a qualified and licensed professional engineer and a qualified and licensed architect, one year of homeowner's property insurance, one year of earthquake insurance if the property is in an earthquake zone, one year of flood insurance if the property is in a FEMA (Federal Emergency Management Agency) area, one year of homeowner's association dues if the property is in a homeowner association, fees for a title report and any other escrow costs.
The house of your choice must be accepted by you as is. The HOYC (House of Your Choice Committee) has no responsibility for the condition or state of repair for the land, or house property, once the house of your choice has been selected.
The house of your choice must be selected within 90 days of the drawing. If not selected within 90 days, the Grand Prize becomes the Second Grand Prize choice listed.
After selecting your house within 90 days, you have an additional 60 days to close escrow, or the prize becomes the Second Grand Prize choice (see Grand Prize Second Option for conditions.)
All of the above is the first option for the grand prize winner of the House of Your Choice.
Option Two - 20 Year Annuity Valued at $1,000,000
The Second Choice Grand Prize is $50,000 cash, subject to state and federal taxes and 19 more annual $50,000 checks due each year upon the anniversary of the drawing. Taxes are the winner's responsibility.
Option Three - $600,000 Cash Prize
The Third Grand Prize Choice is $600,000 cash direct to you subject to state and federal taxes. Taxes are the winner's responsibility.
Other Rules
1. Samuel Dixon Family Health Centers, Inc., a charitable organization under Section 501 (c) (3) of the Internal Revenue Code, for the betterment of the residents of the greater Santa Clarita Valley, is the fiscal agent for House of Your Choice raffle.
2. A maximum of 40,000 entries will be entered in the drawing. Chances of winning depend on the total number of qualified entries.
3. The date of the Grand Prize drawing is Noon (Pacific Standard Time) November 26, 2009.
4. Early Drawings: Early Bird One Drawing is for entries received before May 26. These entries are eligible for a special drawing with a maximum cash prize value of $25,000. Early Bird Two is for entries received between April 26 and June 26 and are eligible for a special drawing with a maximum cash prize value of $10,000. Prize amounts are dependent upon the final number of tickets old.
5. If 15,000 tickets are not sold by the drawing date, the Grand Prize will revert to a cash prize of an amount based upon the number of tickets sold. Similarly, the cash amounts of the two Early Bird prizes will be based proportionally upon the number of tickets sold if 15,000 tickets have not been sold by the drawing date.
6. All entries entered are and shall remain property of HOYC Committee.
7. All entries shall be deposited into a designated account at Wells Fargo Bank and shall be overseen by the HOYC Committee. HOYC shall determine the time and date of the drawing. HOYC reserves the right to postpone or re-schedule the drawing or to determine the winners by random drawing in the event of Acts of God or other circumstances beyond HOYC's control.
8. The person's name appearing on the entry form corresponding to the first entry to be drawn will be awarded the Grand Prize. The Grand Prize Winner will be given the opportunity to choose between the three options available. Prize winners will be announced within 24 hours of the drawing. Winners need not be present to win. Positive identification and a properly completed IRS Form W-9 will be required to claim any prizes. If the winner cannot be reached within 24 hours, HOYC will select an alternate winner through a random drawing of entries.
9. A copy of the complete Rules and Regulations, a list of prizes and, after the event, a list of prize winners can be obtained from HOYC by sending a written request with self-addressed envelope to HOYC, c/o Samuel Dixon Family Health Centers, Inc. 25115 W. Avenue Stanford, A-104, Valencia CA 91355.
10. The entry portion of each drawing form must be completed in its entirety and actually received by HOYC by 11:00pm (Pacific Standard Time) on Wednesday, November 25, 2009 to be eligible to receive any prizes. Entries received after 11:00pm (Pacific Standard Time) on Wednesday, November 25, 2009 will not be eligible to win any prizes. Except as otherwise provided for by HOYC, no other entrants are eligible to win any prizes. All drawing entries are made on-line at www.houseofyourchoice.org.There can be only one name on each entry form.
11. No equivalent prizes or exchanges will be provided. Any taxes and fees are the responsibility of the winner.
12. By entering, all entrants release HOYC, its members, agents, employees and other related entities from any and all liability with respect to prizes.
13. By entering, winners consent to the promotional use of their names and likenesses without any additional compensation.
14. Due to value received, entries are not considered tax deductible by the IRS.
15. A minimum donation of $100 is requested. Free entries defeat the charitable fundraising purpose of this event and are not encouraged. No purchase is necessary and any person may, prior to Monday, November 13, 2009 request one free entry per person, by submitting a written request for such entry and a self-addressed stamped envelope to the mailing address listed in Rule 9 (nine). Requests for free entries will not be accepted after 5 p.m. on Monday, November 13, 2009 or after 40,000 entries have been received.
16. HOYC is not responsible for requests or entries lost in the mail.
17. The winner of the Grand Prize must be over 18 years of age and must pay any applicable sales tax or other fees associated with the grand prize. If the Grand Prize winner is under the age of 18, a parent or guardian may claim the prize.
18. If any winner cannot be located by 24 hours from the date of the drawing, or if the winner is deemed ineligible, such winner will be deemed to have forfeited their prize and another winner will be selected for such prize.
19. HOYC board members and their immediate family members, and HOYC employees and their immediate family members are not eligible to win any prizes from this event. Samuel Dixon Family Health Centers, Inc. board members, and their immediate family members, and employees and their immediate family members are not eligible to win any prizes from this event. Carousal Ranch board members, and their immediate family members, and employees and their immediate family members are not eligible to win any prizes from this event. SCV Rotary board members, and their immediate family members, and employees and their immediate family members are not eligible to win any prizes from this event.
20. All decisions and interpretations of rules and regulations will be made by the HOYC and its judgment is final.
Structure
HOYC is a committee of community members from the Santa Clarita Valley including SCV Rotary members, Samuel Dixon Family Health Center board and staff, Carousel Ranch board and staff, and local business people. The HOYC is a volunteer group dedicated to raising funds and disbursing them in the Santa Clarita Valley. No member of the HOYC, or Wells Fargo Bank or of the recipient charities will benefit personally from this fundraiser. Wells Fargo Bank is the repository of the funds. The HOYC has selected three volunteers as trustees of the funds. The HOYC will conduct an independent audit at the conclusion of the drawing by a certified accounting firm. All operating expenses and prizes awarded will be funded through the receipt of drawing funds.
